Enforce the trademark?

Barry Silbert’s decision to try to mislead investors by calling his EthClassic fund the “Ethereum Investment Trust” triggered much debate in the community this week.

I consider myself neutral here.  As I understand the law, Ethereum may lose control of the Ethereum name if it doesn’t enforce its trademark (as Joe Lubin says).  On the other hand, pursuing legal enforcement of the trademark probably means that only lawyers win in the long-term.

My thought: send a cease and desist letter that includes strong language warning about how investors will likely be mislead because we’ve already seen that occur.

Silbert would have a small PR victory among the shrill group of libertarians who believe that all IP is bad.  But he’ll also have to think twice about whether the name is really worth it – because any unhappy investor in the future would have a piece of evidence to bolster a claim that they were mislead.
